NSW: New laws won't apply in case of Perth baby killed by car

The WA opposition claims a perth man who allegedly drove into a mother and her baby
.. killing the 11 month old girl .. faces less than two years' jail if convicted.

GRACE MOORBY was fatally injured when a V8 Holden Monaro allegedly struck her in the
front yard of her parents' Thornlie home .. in south-east Perth .. on Friday.

Her mother .. TANIA MOORBY remains in a stable condition in Perth Hospital.

24 year-old BENJAMIN ALAN BUTLER has been charged with dangerous driving causing death
and drunk driving.

But Attorney-Genearl JIM McGINTY has today revealed he won't be subject to proposed
new laws which dramatically increase the penalties for dangerous driving causing death.

Shadow police and justice minister ROB JOHNSON says because the government has been
slow to move on the new legislation the driver if found guilty will be eligible for parole
after 14 months.

He says this is because the current maximum penalty of four years carries an automatic
one-third discount.
